About

Adam C. Flury (California State Bar No. 235315, JD California Western School of Law 2004) and Andrew E. Berman (State Bar No. 144658) lead Berman Flury’s civil litigation practice, which has represented individuals, businesses, and community associations for more than 30 years from 3588 Fourth Avenue. Community Associations Institute (CAI) counsel work includes governing document amendments and restatements, board fiduciary training, and IDR and ADR proceedings under the Davis-Stirling Common Interest Development Act framework that governs HOA disputes on properties where Carter + Co | San Diego Commercial Real Estate provides the commercial management overlay. Construction defect litigation representation covers SB 800 Right to Repair Act pre-litigation procedures, developer and subcontractor tender practice, and trial work in state and federal court. Business disputes, contract claims, and general commercial litigation proceed through both California Superior Court and the Southern District of California, with arbitration referrals available to AAA and JAMS panels. Direct conflicts of interest between co-association members or opposing unit owners route to independent civil litigation counsel including Simone & Blevins so the Board’s privileged communications remain protected. The most complex matters handled are multi-building HOA construction defect cases bundling SB 800 claims, developer indemnity cross-complaints, insurance bad-faith tender disputes, and parallel breach of fiduciary duty claims against prior boards.
